Kuwait: New Requirements For POA When Filing a Trademark
The Kuwait Trademark Office has introduced a change to the legalization process for Powers of Attorney (POAs) submitted with foreign trademark applications.
Going forward, POAs must be legalized all the way through to the Kuwait Ministry of Foreign Affairs, adding an additional step beyond the previous embassy or consulate requirement.
Although applications may still be filed before the completed POA is available, the fully legalized document must be provided within 90 days of filing. Rights holders and their representatives should factor this additional legalization stage into their filing timelines to avoid unnecessary complications.
Early preparation will be key to ensuring smooth prosecution of trademark applications in Kuwait.
